先正达公司在中国就苯并烯氟菌唑和氟唑菌酰羟胺成功专利维权

近日，先正达农作物保护股份公司和先正达集团股份有限公司(以下统称“先正达公司”）在中国就两款关键农药化合物产品取得了专利侵权行政裁决的胜利。上海市奉贤区知识产权局于2025 年11月18日作出两项裁决：谱析（上海）生物科技有限公司(以下简称“谱析公司”）侵犯了先正达公司的两项专利。

知识产权局据此作出停止侵权的裁决，责令谱析公司立即停止销售、许诺销售侵犯涉案专利权的苯并烯氟菌唑化合物产品和氟唑菌酰羟胺化合物产品，消除影响，并且不得为生产经营目的使用尚未售出的侵权产品或者以任何其他形式将其投放市场。

本案中，谱析公司官网上有被控侵权产品的下单链接，构成要约的意思表示，许诺销售行为成立。先正达公司的证据表明，谱析公司官网接受了含有被控侵权产品的订单，并且向订单提交方发送了订单确认收到通知，知识产权局认为，虽然没有实际发货，订单人对谱析公司的要约所做的承诺已到达谱析公司，且谱析公司已予以确认，因而买卖合同成立，进而销售行为成立。

此外，由于专利说明书中记载，涉案专利权利要求保护的化合物可以以不同的异构体形式存在，包括同位素形式，谱析公司许诺销售的同位素形式的被控侵权产品同样被认定为落入涉案专利权利要求的保护范围，构成对涉案专利权的侵犯。

根据专利纠纷行政裁决相关法律规定，专利侵权纠纷行政裁决书自作出之日起即生效。不论谱析公司是否向法院提起行政诉讼，均应承担立即停止侵权行为的责任。谱析公司期满不起诉又不停止侵权行为的，奉贤区知识产权局可以申请人民法院强制执行。为解决行政裁决不能及时执行的困境，根据2025年2月1日起施行的《专利纠纷行政裁决和调解办法》，管理专利工作的部门自被执行人的履行期限届满之日起三个月未申请人民法院强制执行的，生效的行政裁决确定的权利人被赋予了在六个月内申请人民法院强制执行的权利。

苯并烯氟菌唑和氟唑菌酰羟胺是先正达公司开发的创新杀菌剂，先正达公司在中国拥有覆盖苯并烯氟菌唑和氟唑菌酰羟胺活性成分、其合成方法、混剂、制剂以及用途的专利权。涉案核心化合物专利目前处于有效状态。任何未经先正达公司许可而在中国境内为生产经营目的制造、使用、许诺销售、销售、进口苯并烯氟菌唑和氟唑菌酰羟胺产品（包括含有苯并烯氟菌唑或氟唑菌酰羟胺成分的其它产品）的行为都涉嫌侵犯先正达公司的专利权。先正达公司高度重视知识产权保护，对侵犯先正达公司专利权的任何单位和个人，将采取一切法律手段追究其民事、行政和刑事责任，以维护本公司的合法权益。

目前在中国境内，只有先正达公司及其关联公司取得了苯并烯氟菌唑和氟唑菌酰羟胺原药及其相关杀菌剂制剂的农药登记，可以合法在中国境内进口有关产品（包括原药和制剂）并授权分装和经销有关产品。先正达公司敬请广大用户和消费者在购买、使用含苯并烯氟菌唑和氟唑菌酰羟胺成分的农药产品时认明正品，避免自己的合法权益受到损害。

Syngenta CompanySuccessfully Enforced Patent Rights forBenzovindiflupyr and Pydiflumetofen in China

Recently, Syngenta Crop Protection Co., Ltd. and Syngenta Group Co., Ltd. (hereinafter collectively referred to as "Syngenta Company") secured victories in administrative adjudications regarding patent infringement for two key pesticide compound products in China. On November 18, 2025, the Intellectual Property Office of Fengxian District, Shanghai issued two adjudications, finding that Puxi (Shanghai) Biotechnology Co., Ltd. (hereinafter referred to as "Puxi Company") had infringed upon two patents owned by SyngentaCompany.

Based on the above findings, the Intellectual Property Office issued adjudicationsto cease the infringement, ordering Puxi Company to immediately cease the sale and offer for sale of the Benzovindiflupyr and Pydiflumetofen compound products that infringe the patents in dispute, eliminate the negative effects, and not to use any unsold infringing products for production and business purposes or placing them on the market in any other form.

In these cases, Puxi Company’s official website contained order links for the accused infringing products, which constituted an expression of intent to make an offer, thereby establishing the act of offer for sale. Evidence provided by Syngenta Company showed that Puxi Company’s official website accepted orders containing the accused infringing products and sent order confirmation notices to the order submitters. The Intellectual Property Office held that, although no actual delivery was made, the acceptance from the order submitter regarding Puxi's offer had been received and confirmed by Puxi Company. Therefore, the sales contract was formed, and accordingly, the act of sale was established.

In addition, as recited in the patent specification, the compounds protected by the claims of the patent in dispute may exist in different isomeric forms, including isotopic forms. The accused infringing products in isotopic form offered for sale by Puxi Company were also found to fall within the protection scope of the claims of the patent in dispute, constituting an infringement of the patent in dispute.

Pursuant to the relevant legal provisions, the administrative adjudicationon a patent infringement dispute takes effect immediately upon issuance.Regardless of whether Puxi Company files an administrative lawsuit with the court, it is obliged to immediately cease the infringing acts. If Puxi Company fails to file a lawsuit within the prescribed time limit and refuses to cease the infringing acts, the Intellectual Property Office of Fengxian District may apply to the court for compulsory enforcement. To address the predicament of delayed enforcement of administrative adjudications, according to《Measures for Administrative Adjudication and Mediation of Patent Disputes》(effective February 1, 2025), if the patent administration department fails to apply to the court for compulsory enforcement within three months from the expiration date of Puxi Company's performance period, Syngenta Company is granted the right to apply to the court for compulsory enforcement within six months.

Benzovindiflupyr and Pydiflumetofen are innovative fungicides developed by Syngenta Company.Syngenta Company holds patents in China covering the active ingredients, synthesis processes, mixed formulations, sole formulations, and uses of Benzovindiflupyr and Pydiflumetofen. The core compound patents in dispute are currently in valid status. Any act of manufacturing, using, offering to sell, selling, or importing products containing Benzovindiflupyr or Pydiflumetofen(including other products containing either Benzovindiflupyr or Pydiflumetofen) in China for production or business purposes without Syngenta Company’s prior authorization shall be deemed an suspected infringement of Syngenta Company’s patent rights.Syngenta Company attaches great importance to the protection of intellectual property rights. For any entity or individual that infringes upon Syngenta Company’s patent rights, Syngenta Company will take all necessary legal measures to pursue their civil, administrative, and criminal liabilities, so as to safeguard the company’s legitimate rights and interests.

Currently, within China, only Syngenta Companyand its affiliated companies have obtained pesticide registrations for Benzovindiflupyr and Pydiflumetofen A.I.s as well as their related fungicide formulations, and arelegally authorized toimport the relevant products (including A.I.s and formulations) into China, and authorize the repackaging and distribution of these products. Syngenta Companyhereby reminds all users and consumers to verify the authenticity of pesticide products containing Benzovindiflupyr or Pydiflumetofen when purchasing and using them, so as to avoid any damage to their legitimate rights and interests.
